baez the abuser (of justice)

by Andrea O'Connell

In the State v. Casey Anthony case, attorney Jose Baez is trying to weave his own version of reasonable doubt, using George Anthony as bait.

Does Baez really think this abuse story will add reasonable doubt to lessen Casey Anthony’s actions during those 31 days of her  beautiful-life, bliss?

Oh please.

His allegations are so outrageous, and so poorly planned, that it makes me wonder what the heck has Baez been doing these past three years?  What was he doing?    Apparently not much.

No lawyer – especially if they’d never tried a death penalty case – would play with someone’s life like this.  How could Baez pretend he has what it takes to defend a case that cannot be rationally defended?  Most lawyers would have explained to Casey Anthony that her case cannot be won, there is too much evidence against her, and she needs to discuss an alternative sentence, i.e. a plea deal.

Furthermore, it should be malpractice for an attorney to take a case he doesn’t have the experience to defend.

Just because your client says they’re innocent doesn’t mean the lawyer has to believe it!

You may think, it’s easy for me to sit here and judge.  And, that’s true. However, anyone with a single iota of common sense or appreciation for the law, will clearly see what I see.

The Baez Scam

What Baez has created in only the first week of the trial, is the opportunity for the jurors to realize, in no uncertain terms, that his client is indeed guilty.

Baez admits she lied; she’s irresponsible; she made up the Nanny; she lied to Law Enforcement; to her parents, her friends, and even to her boyfriend.  Why?  She was abused, Baez claims.

So, how did he come up with these abuse claims?   Clearly this came from the letters Casey Anthony wrote to Robyn Adams while in jail in which Casey Anthony has discussed her past.

I will say that it may be true that Lee did something to abuse Casey, because she told Jesse, and Tony about it.  However, I would not doubt that the Lee allegations are a figment of her imagination and a ploy for attention or sympathy.

Lee Anthony received special attention in his teen years as a result of some form of autoimmune problem.  He was unable to play sports and I believe he was out of High School for a while during his rehabilitation.  As such, Lee received special attention, and no doubt Casey was jealous.  It appears that Casey was jealous of the attention and lavish gifts and love that Cindy and George Anthony heaped on Caylee.  I wonder, did Casey create a lie about Lee to get sympathy from her mother?

The Young Girl

When Jose Baez referred to Casey Anthony as a young girl, it was to present her as a victim since her youth.  An attempt to try to get the jury to see her as young and harmless – as a young loving mother.

Mr. Baez says in his opening statement,

Casey cried and cried and asked for her father’s help.  She should have been stronger and called 911, but her death was covered up.  Why did George do this?  Why did he cover it up?

Why did George cover it up?!!  Wasn’t Casey a party to this, also?  Poor young Casey, she was deathly afraid of her father who threatened to expose her as a neglectful mother.

Just a pile of nonsense!  Pure, unadulterated nonsense!

When the State of Florida plays the recording of Casey from the jail in which she sounds like a witch who could care less for her daughter, the jury’s eyes will be opened WIDE.

When the jury sees the jail tapes – the cold, calculated way Casey reacted to questions about Caylee, and calling herself the victim, they will know who Casey really is.

When they hear Casey’s reaction (in the jail videos), cynically saying, “Surprise, surprise,” to her mother’s mention of the rumors that Caylee drowned in their pool, the jury will know George had nothing to do with Caylee’s death.   And there was NO drowning.

If Caylee drowned (and we will never know if she did or not), was it due to Casey drowning her?  Did Casey intend for Caylee to drown?  Is that why the ladder was left up?

I don’t think drowning is a plausible scenario given Casey’s reaction in that jail video.

The Anthony’s Attorney Intervenes

Last week, the State of Florida filed a motion in limine to require the Defense to stop the references to items not in evidence, such as the abuse claims.  Judge Perry granted the motion and the defense responded with a speaking motion to declare a mistrial.  Of course, that was denied.

At the close of Saturday’s testimony, Mark Lippman notified the court of the Anthony’s wish to file a motion in this case.  Judge Perry asked the State and the Defense if there were any objections.  The State (of course) did not object, the Defense did.

Judge Perry will hear the motion tomorrow morning, at 8:30 a.m.

Attorney Richard Hornsby wrote a superb post about this.  You will enjoy reading it, I promise!  The Hornsby post.

The best outcome from all of this would be for the Judge to give the jury an instruction to disregard the Defense statements about the abuse or the drowning.  We all know there is no evidence of drowning!

There is no evidence of abuse other than Casey Anthony’s self-serving letters to Robyn Adams.  The problem for Baez, the jail letters with Casey’s abuse claims are inadmissible.

To introduce any abuse into the trial would have to be from Casey Anthony herself, on the stand.

Is Casey that bold?

Who’s the Abuser?

There are two abusers in this story, and they are two peas in a pod:  Casey and Baez are the two abusers of justice, truth, and honesty.

With any luck, Judge Perry will drop the curtain on this ridiculous fiction – this moronic abuse of the truth.

This trial is just like a really bad movie….you keep wondering if the producers are smoking crack! SERIOUSLY, is Baez, Mason Jar, Simms and Finnel so into the case that they cannot step aside and say what does this theory look and feel like? I think that Baez has had his eyes on the money the entire time! what junior lawyer would EVEN think that they were skilled enough to take on this case AND be lead attorney? I think that he has made such a bad name for himself that nobody will buy or read any book that he writes on the case.

I read some of the comments from yesterday and how some feel that Cindy and George do not deserve any respect after their actions. First, NONE of us have ever been in this situation, we may say that we would do certain things but when you are torn apart, in shock, denial and trying to make your life seem real you will do ANYTHING to make it comfortable again. Yes, Cindy said and did some awful things but she is a woman, a mama bear-come on give the woman a break…she may have not been a great parent but for heavens sake she does not deserve this nor does George!

      Whistlersmother – AMEN!
I was just heading for bed, but had to stop and say thank you for your comments. I agree with you, that “there for the grace of God go we.”

We are human beings with faults, foibles, we make mistakes sometimes. But, the thing that really makes us human is our ability to forgive.
I know I was very harsh on both of the Anthony’s – though I was originally sympathetic toward them (we all were), that changed when they seemed to do everything to thwart justice….
I think they have now seen the light – and I’m sure it’s a glare they’d just as soon hide their eyes from, the fact is, they are suffering a humiliation that none of us would wish on anyone! I only hope the truth that Cindy shares will set her free from some of the pain, George too.

It’s the most awful thing…. I don’t understand it – Casey must have a great deal of hate inside of her…..

Yes, HHJP will tell the jury not to consider any sex abuse allegations since there was no proof given. As for the drowning theory, that can be considered even the part about what they said George did when he retrieved Caylee out of the pool. The State will point out what a preposterous theory it is. Even more so is that Casey was afraid of her parents/father because of why? Sex abuse-but that won’t be considered.

According to Anonymous at Dr. Glass’ latest post Baez cannot put Casey on the stand because he has said she is a liar and to put her up there knowing she most likely will lie is subjourning perjury. That’s a crime. However, listening to Richard Hornsby on Websleuth’s radio show from last week he said Baez has to put her on the stand to prove the sex abuse allegations. IMO, Baez has zccomplished all he set out to do with that allegation and that was to plant that seed in the jury’s minds.

I swung this thought by Jonathan at mainstreamfair~

Could it be that Baez was afraid that JAC lawyers would investigate him if he just left it at accidental drowning? I think the reason he introduced Kronk and all this wild stuff is because he had asked for funds for investigations. I do believe those funds were abused. I would hope JAC was able to investigate the investigators Baez hired.

I found this telling of Casey’s demeanor.

“It is somewhat deceptive in the way the camera portrays what Casey is looking at and what I feel she actually is. The camera that catches Casey is behind, above and to the right of the witness box. Casey and the defense team are on the far opposite wall. Most of the time Casey is either looking blankly to the front or to her left. She rarely looks at the witness on the stand.”

Rather denigrating and embarrassing to have mother-daughter physical inspection. geez. What is the point? Well, at least Casey can claim her mother looked at her today!

    Hi Andrea!
Baez asking questions is no different than me after my 3rd beer, I start to loose my train of thought too. He then heads outside the scope, not once but several times until a sustained objection and then starts a new line of questions out of left field. This is nothing less than lack of experience! Mason not being able to question witnesses will be part of the Baez undoing. Mason will have his own problems because he still thinks it’s 1968 and you start a line of questioning with a comedy routine.
I have been hearing about how “Cindy has turned”, not so, she just stopped fighting with the state and is answering questions pretty honest based on her depositions. The only thing that has turned is the defense blaming the entire family for Casey’s actions. The last time I looked Casey’s name was on top the indictment and not Cindy, George or Lee. Poor Kronk just happened to be at the wrong place at the wrong time. The defense has nothing on the Anthony family other than what they picked up by the public, they are “strange and in denial.” I don’t know who they can put on the stand to corroborate the accusations made by Casey…..it’s no one on the witness list. So like Casey and the imaginary nanny with imaginary friends, the defense has made up an imaginary answer to why Casey lied but didn’t kill her daughter…..HA, I say! Casey was the last one to see Caylee and the rest is imaginary……I imagine she probably killed her……..

      Well said, damagdpets!

I inmagine Baez thinks that the things that ticked off the bloggers these last three years about the Anthonys will also tick off the jury members. That’s why he was bringing up the making money off of Caylee line of questioning. I wonder if he thinks any success of making the Anthonys out to be the worst parents in the world will acquit Casey-he seems that dumb, imo.

Hey Damagedpets! You’re comments really gave me a good chuckle – thank you, I needed that! Just priceless! I bet you’d sound better than Baez even after a six-pack of beer!
And I think you’re correct that Cindy has just stopped fighting now.

Jose Baez is probably being paid state rates for this defense. Casey Anthony was declared indigent so the state is picking up the costs of her defense. It isn’t the money that motivates him. Nor is it any sense of seeking justice. Baez is a showboat who is hoping for an “OJ moment”. If he can get Casey acquitted he will be instantly famous, like Johnny Cochran, et al. He would be able to write books, sell interview, go on the lecture circuit and so forth.
However, so far he is coming across as scatterbrained and out of touch. His handling of the witnesses is going to begin to alienate the jury. He is ultimately going to lose. I look forward to hearing the verdict of guilty read aloud in court.

I believe Casey unknowingly used too much chloroform on Caylee which resulted in her death. I do believe Casey would drug Caylee so she could party and be free to do whatever she wanted.

Or Casey could have purposely killed Caylee because the child was getting to the age of being able to tell family and friends about babysitters and other information.

Lastly, Jose Baez smirks entirely too much. Egads!
